The legal footing comes from the Durbin Amendment, passed as part of the Dodd-Frank financial reform legislation in 2010, which bars payment card networks from preventing a merchant from offering a discount or in-kind incentive for payment by cash, check or debit. The card brands have since published their own rules for how these programs must be disclosed.
